The Wisconsin Supreme Court Issues a Preliminary Injunction From
Implementing the New Benefits Bill (1999 Wisconsin Act 11) Until Further
Order of the Court


On December 29, 1999, the Wisconsin Supreme Court granted a complete
injunction from implementing the provisions of 1999 Wisconsin Act 11 until
further order of the Court. However, the Department of Employe Trust Funds
has been given the authority to continue planning for the legislation's
potential implementation as the Department deems appropriate.

The Court has also ordered the Respondents (George Lightbourn, Acting
Secretary of the Department of Administration and Jack Voight, Wisconsin
State Treasurer) to file a response to the Petitioner's (Employe Trust Funds
Board and Eric Stanchfield, Employe Trust Funds Secretary) proposed
complaint seeking a declaratory judgement by January 21, 2000. The
respondents must specifically address any factual matters raised by the
petition for original jurisdiction/proposed complaint that they dispute.

The Court has said that they will not make a decision on the original
jurisdiction request until after the response brief is filed on January 21,
2000 and after considering any other matters that the Court may require the
parties to address.
